2. Definitions
In these Terms:
“We”, “us” or “our” means CardLogic Limited trading as AssetTags.ie.
“You” or “customer” means the person, company or organisation purchasing products from us.
“Consumer” means an individual purchasing mainly for purposes outside their trade, business, craft or profession.
“Business Customer” means a customer purchasing wholly or mainly for business, commercial, professional or organisational purposes.
“Custom Products” means products manufactured, printed, engraved, numbered, encoded or otherwise produced to a customer’s specifications.
3. Products
We supply asset tags, asset labels, identification plates and related products, including standard and custom-manufactured products.
We take reasonable care to ensure that product descriptions, specifications and images shown on our website are accurate.
However, images are provided for illustrative purposes and minor variations may occur between screen representations, samples and finished products.
In particular, colours displayed on a monitor may differ from printed or manufactured colours.
Nothing in this section affects a consumer’s statutory rights where goods do not conform to the sales contract.
4. Quotations and Prices
Prices displayed on the website or provided in quotations are subject to the terms stated at the time.
Where applicable, prices will state whether VAT is included or excluded.
Before a consumer completes an online purchase, the total price payable, including applicable VAT and any delivery charges that can reasonably be calculated in advance, will be shown.
Where a product requires custom specifications or a quotation, the final price may depend on factors including:
- Quantity
- Size
- Material
- Adhesive
- Printing method
- Numbering
- Barcodes or QR codes
- Artwork requirements
- Finishing options
- Delivery destination
Unless otherwise stated, quotations are valid for the period shown on the quotation.
We reserve the right to correct genuine pricing, typographical or calculation errors before accepting an order.
5. Placing an Order
An order placed through our website or submitted to us is an offer to purchase the relevant products.
A contract is formed when we accept your order.
Acceptance may be confirmed by:
- An order confirmation
- Written confirmation by email
- Acceptance of payment
- Approval of a quotation or purchase order
- Commencement of production
For Custom Products, production may also be conditional on approval of artwork or specifications.
We reserve the right to decline an order before a contract is formed, including where:
- A product is unavailable
- Pricing is incorrect
- Required specifications have not been provided
- We are unable to manufacture the product requested
- Payment has not been received or authorised
6. Custom-Made Products
Many products supplied by AssetTags.ie are manufactured specifically to the customer’s requirements.
Custom Products may include:
- Printed asset labels
- Foil asset tags
- Aluminium asset tags
- Stainless steel or brass plates
- Sequentially numbered tags
- Barcode labels
- QR code labels
- Products containing customer logos or artwork
- Products manufactured to custom dimensions
- Products using customer-selected materials or adhesives
Once production has begun, Custom Products normally cannot be changed or cancelled.
For consumers, this is subject to applicable statutory rights. In particular, the standard cancellation right that applies to many distance purchases does not generally apply to goods made to a consumer’s specifications or clearly personalised.
7. Artwork and Proof Approval
Where appropriate, we may provide an artwork proof before production.
It is the customer’s responsibility to check the proof carefully.
This includes checking:
- Spelling
- Grammar
- Contact information
- Serial numbers
- Numbering sequences
- Barcodes
- QR codes
- Logos
- Colours
- Dimensions
- Layout
- Positioning
- Product specifications
Production will normally begin once the customer has approved the proof.
Approval confirms that the customer accepts the artwork and specifications shown.
Where goods have been manufactured correctly in accordance with an approved proof, we are not normally responsible for errors that were present in that approved proof.
This does not affect a consumer’s statutory rights where the finished goods are faulty or do not conform to the approved specification.
8. Customer-Supplied Artwork and Information
The customer is responsible for ensuring that all artwork, logos, text, numbering, barcode information, QR code data and other information supplied to us is accurate.
The customer must also have the necessary rights or permission to use any artwork, logos, trademarks or other intellectual property supplied to us.
We are not responsible for errors in the finished product that result directly from incorrect information supplied or approved by the customer, provided the product has been manufactured in accordance with that information.
9. Colours and Printing
Exact colour reproduction cannot always be guaranteed.
Colours may vary depending on:
- Material
- Printing process
- Surface finish
- Screen calibration
- Ink or manufacturing batch
- Substrate colour
Where Pantone, CMYK or other colour references are supplied, we will make reasonable efforts to reproduce the requested colour accurately.
Unless we expressly agree otherwise in writing, minor commercially acceptable colour variation will not constitute a defect.
This does not affect statutory consumer rights.
10. Dimensions and Manufacturing Tolerances
Custom-manufactured products may be subject to reasonable manufacturing tolerances.
Minor variations in dimensions, position, cutting, printing, engraving or finishing may occur as part of normal manufacturing processes.
Where a particular dimension, tolerance or positioning requirement is critical to the intended application, the customer should notify us before placing the order.
Any specific tolerance agreed by us in writing will form part of the contract.
11. Adhesives and Product Suitability
Different adhesives and materials are suitable for different surfaces and environments.
Factors affecting performance may include:
- Surface material
- Surface texture
- Paint or coating
- Cleanliness
- Temperature
- Moisture
- Chemical exposure
- UV exposure
- Outdoor conditions
- Application method
Customers should provide us with relevant information about the intended application where product suitability is important.
Where appropriate, we may recommend a product or adhesive based on information provided by the customer.
Unless expressly guaranteed by us, customers should carry out suitability testing where adhesion or environmental performance is critical.
Nothing in this section limits consumer rights where the customer makes a particular intended purpose known to us before purchase and we accept that requirement as part of the contract.
12. Samples
Where samples are supplied, they are intended to demonstrate the general characteristics of the product.
Minor differences may occur between samples and final production runs due to material or manufacturing variations.
Where a particular characteristic is essential, it should be agreed with us in writing before production.
13. Payment
Payment terms will be shown during checkout, stated on our quotation, invoice or otherwise agreed in writing.
We may require full payment before production begins, particularly for Custom Products.
For approved Business Customers, credit terms may be offered at our discretion.
Where credit terms are provided, payment must be made within the agreed period.
We reserve the right to suspend production, dispatch or further orders where payment is overdue.
14. VAT
VAT will be charged where required by law.
Where prices are displayed to consumers, applicable taxes will be clearly shown as required.
Business quotations or trade prices may be displayed exclusive of VAT where this is made clear.
15. Production Times
Production times shown on the website or provided in correspondence are estimates unless expressly agreed otherwise.
Production time normally begins only after we have received:
- Payment where required
- Final specifications
- Usable artwork
- Artwork approval where applicable
Delays in providing artwork, approval, payment or other required information may delay production.
16. Delivery
Estimated delivery dates are provided in good faith.
Unless a specific delivery date has been expressly agreed, delivery dates are estimates and may be affected by circumstances outside our reasonable control.
These may include:
- Courier delays
- Weather
- Transport disruption
- Customs delays
- Supply chain disruption
- Events outside our reasonable control
Consumer orders will be delivered in accordance with applicable consumer law.
Delivery charges will be displayed or communicated before the order is completed where applicable.
17. Delivery Address
The customer is responsible for providing a complete and accurate delivery address.
We are not responsible for delays or additional charges resulting from an incorrect or incomplete address supplied by the customer.
Additional delivery charges may apply where goods must be redirected or re-delivered due to incorrect customer information.
18. Inspection on Delivery
Customers should inspect goods as soon as reasonably possible after delivery.
If goods appear damaged in transit, customers should contact us promptly and provide photographs where possible.
Business Customers should notify us of apparent shortages, damage or manufacturing issues within a reasonable period after delivery to allow us to investigate.
Any notification period applicable to Business Customers does not restrict statutory rights available to consumers.
19. Faulty or Incorrect Goods
If goods are faulty, damaged, incorrectly manufactured or do not conform to the contract, please contact us.
Consumer customers are entitled to the remedies provided by Irish consumer law.
Depending on the circumstances, these may include:
- Repair
- Replacement
- Price reduction
- Refund
Nothing in these Terms limits or excludes statutory consumer rights.
Further information is available in our Refund & Returns Policy.
20. Consumer Cancellation Rights
Consumers purchasing standard, non-personalised products online may have a statutory right to cancel their order within 14 days of receiving the goods.
This right does not generally apply to goods that are:
- Made to the consumer’s specifications
- Clearly personalised
- Custom printed
- Custom numbered
- Custom engraved
- Otherwise manufactured specifically for that customer
Details of cancellation rights and returns are set out in our Refund & Returns Policy.
21. Business Orders
Where a customer purchases primarily for business, trade, commercial or professional purposes, consumer cancellation rights do not apply.
Business orders for Custom Products cannot normally be cancelled after production has begun unless we agree otherwise in writing.
Nothing in these Terms excludes rights that cannot lawfully be excluded.
22. Quantity Variations
Where Custom Products are manufactured in bulk, the quantity supplied will normally match the quantity ordered.
If a production process may result in an overrun or underrun, this will be agreed with the customer in advance where relevant.
Any material variation from the agreed quantity will be addressed with the customer.
23. Ownership of Goods
For Business Customers, ownership of goods remains with CardLogic Limited until we have received payment in full for those goods.
Risk in the goods will pass in accordance with the applicable delivery arrangements and law.
Nothing in this clause affects statutory rules applying to consumer purchases.
24. Intellectual Property
All website content, including text, graphics, photographs, designs, product information and website layout, belongs to CardLogic Limited or is used under licence unless otherwise stated.
It may not be reproduced, distributed or commercially used without permission.
Customers retain ownership of artwork and intellectual property they supply to us.
By supplying artwork or other materials, the customer grants us permission to use those materials as reasonably necessary to manufacture and fulfil the order.
25. Use of Completed Work for Marketing
Unless otherwise agreed, we may photograph or display examples of products we manufacture for promotional or portfolio purposes where this does not disclose confidential information or personal data.
If you do not want your products or branding used in this way, please tell us before production.
26. Liability
Nothing in these Terms excludes or limits liability where it would be unlawful to do so.
In particular, nothing limits a consumer’s statutory rights.
For Business Customers, to the maximum extent permitted by law, we will not be liable for indirect or consequential losses arising from the use of our products, including loss of profit, revenue, business or anticipated savings.
For Business Customers, our total liability arising from a particular order will normally be limited to the amount paid for that order, except where such a limitation would be unlawful.
27. Product Use
The customer is responsible for using products in accordance with their intended purpose and any instructions supplied.
We are not responsible for damage resulting from:
- Misuse
- Incorrect application
- Unsuitable storage
- Unauthorised modification
- Accidental damage
- Normal wear and tear
This does not apply where the product itself was faulty or did not conform to the contract.
28. Events Outside Our Control
We will not be responsible for delays or failures caused by events outside our reasonable control.
Examples include:
- Natural disasters
- Fire
- Flooding
- Industrial disputes
- Transport disruption
- Government action
- Power or telecommunications failures
- Significant supply-chain disruption
We will take reasonable steps to minimise disruption where possible.
29. Complaints
If you have a complaint about an order or product, please contact:
Email: info@assettags.ie
Telephone: 01 506 5661
Please provide your order number and details of the issue.
We will make reasonable efforts to investigate and resolve complaints promptly.
30. Privacy
Personal information supplied to us is processed in accordance with our Privacy Policy and applicable data protection law.
CardLogic Limited is the data controller for personal data processed through AssetTags.ie unless otherwise stated.
31. Changes to These Terms
We may update these Terms & Conditions from time to time.
The version applicable to an order will normally be the version in effect when the order is placed.
Changes will not retrospectively alter an existing contract unless required by law or agreed with the customer.
32. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.
33. Governing Law and Jurisdiction
These Terms and any contract between you and CardLogic Limited are governed by the laws of Ireland.
For consumers, this clause does not deprive you of any mandatory legal protections that apply in your country of residence.
For Business Customers, unless otherwise agreed, the courts of Ireland will have jurisdiction over disputes arising from these Terms or an order.
34. Statutory Rights
Nothing in these Terms & Conditions is intended to limit, restrict or exclude any statutory rights available to consumers under Irish or applicable EU law.
Consumer purchases are subject to applicable legislation including the Consumer Rights Act 2022.
